1. Acceptance of Terms
By accessing or using One Trillion Brackets (the “Site”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to all of the Terms, do not use the Site.
2. Modifications
We may update these Terms at any time. Changes become effective when posted. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
3. The Bracket App
The Site provides an interactive collection of brackets for entertainment and discussion purposes only. We make no representations or warranties regarding the accuracy, completeness, or reliability of any bracket data. The Site may be unavailable, interrupted, or contain errors at any time.
4. User Conduct
- No scraping, crawling, or automated data collection without prior written consent.
- No interference with or disruption of the Site or its infrastructure.
- No use of the Site for unlawful, abusive, or malicious purposes.
5. Intellectual Property
All original content on the Site (including code, design, text, graphics, and layout) is owned by or licensed to us and is protected by applicable intellectual-property laws. You may link to publicly accessible pages, but you may not copy, reproduce, modify, distribute, or reverse-engineer the Site or its source code without prior written permission.
6. Email List & Privacy
The only personal information intentionally collected by the Site is an email address voluntarily submitted to join our mailing list. Email addresses are used solely for Site-related communications and are not sold. You may unsubscribe at any time using the link provided in our emails.
We may also collect limited technical information automatically (such as IP address, browser type, or device information) through standard server logs and third-party analytics tools.
The Site uses third-party services, including:
- Google Analytics for aggregated usage statistics.
- Google AdSense to display contextual advertising.

9. Limitation of Liability
To the fullest extent permitted by law, in no event shall our total liability for any claim arising out of or relating to the Site exceed USD 100.
10. Indemnification
You agree to indemnify, defend, and hold harmless One Trillion Brackets and its operator from any claims, damages, losses, liabilities, and expenses arising from your use of the Site or your violation of these Terms.
11. Termination
We reserve the right to suspend or terminate access to the Site at any time, with or without notice, for any reason, including without limitation suspected misuse or violation of these Terms.
12. Voluntary Contributions (Tips)
You may choose to send an optional monetary tip through third-party payment services (e.g. Venmo or PayPal). Tips are purely voluntary, do not purchase any product or service, and are non-refundable except as required by the payment processor’s policies. Tips are not tax-deductible.
By submitting a tip, you confirm that you are at least 18 years old (or have permission from a parent or guardian). All payment information is processed directly by the third-party provider and is subject to its own privacy policy and terms.
13. Minors
The Site is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe such information has been submitted, please contact us so it can be removed.
14. No Affiliation with NCAA or Sports Organizations
This Site is not affiliated with, sponsored by, endorsed by, or in any way officially connected with the National Collegiate Athletic Association (NCAA), CBS Sports, Turner Broadcasting, the Associated Press, any college, university, athletic conference, or any other sports organization. All team names, logos, and tournament references are used for informational and entertainment purposes only and remain the property of their respective owners. No endorsement or sponsorship by any such organization is implied.
15. Gambling Disclaimer
The Site is not a gambling service, sportsbook, or betting platform. We do not accept wagers, facilitate betting, or provide odds. Any bracket data, statistics, or analysis provided on the Site is for entertainment and informational purposes only and should not be used as the basis for any wagering or financial decisions.
If you choose to use any information from the Site in connection with gambling or wagering activities, you do so entirely at your own risk. We expressly disclaim any and all liability for gambling losses, failed bets, or any financial harm arising from reliance on the Site's content. You acknowledge that bracket outcomes are inherently unpredictable and that past data does not guarantee future results.
16. Force Majeure
We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, power outages, internet or telecommunications failures, cyberattacks, or failures of third-party hosting or cloud service providers (including but not limited to Amazon Web Services).
17. Dispute Resolution & Class Action Waiver
Informal Resolution: Before initiating any formal dispute proceeding, you agree to first contact us at the email address below and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration: If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Colorado, USA, and the arbitrator's decision shall be final and binding.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.
Exceptions: Either party may bring an individual action in small claims court for disputes within that court's jurisdiction. This arbitration agreement does not preclude you from bringing issues to the attention of federal, state, or local agencies who may seek relief on your behalf.
18. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The invalidity of any provision shall not affect the validity or enforceability of the remaining provisions, which shall continue in full force and effect.
19. Entire Agreement & No Waiver
These Terms, together with any other legal notices published on the Site, constitute the entire agreement between you and One Trillion Brackets regarding your use of the Site and supersede all prior agreements, understandings, and communications, whether written or oral.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.
20. Governing Law & Venue
These Terms are governed by and construed in accordance with the laws of the State of Colorado, USA, without regard to conflict-of-law principles. Except as otherwise provided in Section 17 (Dispute Resolution & Class Action Waiver), any dispute arising under these Terms shall be brought exclusively in the state or federal courts located in Colorado.
